TERMS & CONDITION

Terms & Condition

Updated August 30, 2023

This “Ticketing Terms and Conditions” sets out the terms and conditions applicable to purchases of Tickets from us. If you are making a purchase online, this Ticketing Terms and Conditions also incorporates our website Terms of Use.

In addition to Tickets, for some events, we may sell other associated items, products and packages including but not limited to VIP Packages, Experience Packages, Merchandise and any other related products and services (referred to in this Ticketing Terms and Conditions as “Tickets”) at separate, additional price. These are sold on behalf of event organisers, promoters, venues, producers, artists/performers, agents, record labels and other persons involved in the organisation of events (“Event Partners”). Please note the responsibility for organising or delivering the events lies with the Event Partners.

The purchase of Tickets is subjected to such additional terms and conditions as the Event Partners may impose in respect of each Event. Tickets are sold as allocated by Event Partners, and in accordance with their instructions. The quantity, price and type of Tickets allocated for sale by us vary on an event by event basis.

Tickets for popular events may sell-out quickly. Our online sales channels (https://tykyt.my Tykyt Event Management) access the same ticketing system and ticket inventory. Inventory and its availability are controlled by Event Partners and therefore occasionally, additional Tickets for sold-out events may become available prior to events.

This Ticketing Terms & Conditions does not apply to any purchases made from any other third parties. If you have any queries or complaints regarding your purchase of Tickets from other third parties, please contact them directly.

For certain events, ticket restrictions may apply. Where a restriction applies to the number of Tickets that may be purchased (whether per person, per credit card or per household) and Tickets are purchased in excess of this number, the excess Tickets will be cancelled.

Certain events may not be appropriate for children and an age restriction will apply. Please note that where age restrictions apply you will need to bring proof of age. Event Partners or their authorised Ticket checkers reserve the right to refuse entry to anyone who is under the applicable age.

In order to discourage, minimise and prevent unfair Ticket buying practices, you are limited to a specified number of Tickets for each event. Tickets may be restricted to a maximum number per person, per credit or debit card or per household. We reserve the right to cancel any order(s) for Tickets purchased in excess of the relevant limits without notice.

You are not entitled to purchase any Tickets as a trader acting in the course of business with the intention of reselling your Tickets for profit. If we discover or have reason to suspect that you have purchased and intend to resell, or have sold Tickets in breach of this clause, we reserve the right to cancel your Tickets without notice.

Your Ticket may not be resold or offered for resale at face value or at a premium over the face value of the Ticket (including via online auction sites) or used for advertising, promotions or other commercial purposes (including competitions, contests and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder. If you are found to be attempting to resell, or have resold your Ticket or used a Ticket in breach of this condition, the Ticket may be cancelled without a refund and the ticket holder may be refused admission.

Tickets purchased from us may not be combined with any hospitality, travel or accommodation service and/or any other merchandise, product or service to create a package for sale or other distribution unless formal written permission is given by us and the relevant Event Partners in advance and provided that even if such permission is granted, use of our or any Event Partners’ trade marks and other intellectual property is subject to the express prior written consent of the owner.

Please read these Ticketing Terms and Conditions carefully before purchasing Tickets. Any purchase of Tickets from this site is subject to any special conditions and/or restrictions which has been brought to your attention during the event announcement, event notification and/or purchase process.

By using this site and purchasing Tickets, you represent that you:

a. are a consumer

b. are at least 18 years old and able to enter into legally binding contracts, and

c. are not a business, trader or person engaged in the resale of Tickets. Purchasing Tickets as, or on behalf of, a person, business or trader engaged in the resale of Tickets is strictly prohibited.

We reserve the right to reject or cancel your purchase if we reasonably find that you do not meet any of the above requirements (we may attempt to contact you beforehand although it is not compulsory for us to do so).

By purchasing Tickets, you agree to be bound by this Ticketing Terms and Conditions, terms and conditions related to attendance at the event, any special terms and conditions stated to be applicable to an Event or product including terms and conditions of the Event Partners and/or Event Venues (including conditions of entry).

Seat Map/Venue Layout displayed on our website and mobile application is not drawn to scale and used for Ticket location purposes only. Published layout is subject to change without prior notice.

Published or advertised Ticket price excludes any per Ticket service and/or facility fee and any per order handling and/or processing fee. Such fees shall vary from event to event at our discretion or as instructed by Event Partners.

For some events that offer an Event Partner, student or senior citizen discount (or such other discount as may be applicable) on the Ticket Price, you must provide appropriate documents (including any student and/or senior citizen identification card) if you seek to secure the discount. We reserve the right to request for such appropriate supporting documents, and such documents must be shown at the time of purchasing the tickets and/or prior to entering the venue. By submitting any such document, you shall be deemed to have read, understood and agreed to our Ticketing Terms and Conditions.

Accepted methods of payment include Visa and MasterCard and/or any other payment method notified to you from time to time through our website, mobile application, event page and/or electronic direct mailer. Payment is taken in full when your confirm your order and finalise your purchase.

We reserve the right to change these Ticketing Terms and Conditions at any time by posting a new version on this site. It is your responsibility to check that you have read the latest version of this Ticketing Terms and Conditions before purchasing your tickets as you will be agreeing to be bound by them.

If you do not agree with this Ticketing Terms & Conditions or any other applicable terms and conditions, or if you cannot comply with any of them, you must not proceed to make a purchase.

These Ticketing Terms and Conditions apply to both the original purchaser and any subsequent ticket holder.

We will not be responsible if you or any guests under your booking are refused admission because of a failure to meet or prove that you/they meet any restrictions.

BOOKING AND PURCHASING YOUR TICKETS

The purchase of Tickets on this site is subject to availability and subject to acceptance by the Event Partner.

We use our best efforts to ensure that the prices of Tickets displayed are correct. If a pricing error is discovered, despite our best efforts, we will contact the Purchaser to inform you of this error. The Purchaser will have the option of continuing with the purchase at the correct price or cancelling your order for a full refund. If we are unable to contact the Purchaser using the contact details provided during the order process, we reserve the right to treat your order as confirmed or cancel your order.

You are strictly prohibited in obtaining or attempting to obtain Tickets through unauthorised use of any robot, other automated device or software or through any other illegal or unauthorised activity. We reserve the right to cancel any orders that we reasonably suspect to have been made in breach of this Ticketing Terms and Conditions without any notice to you, and any and all Tickets obtained as part of such orders will be void.

To prevent fraud and protect us, all purchases are subject to credit or debit card verification (if applicable), other security checks, and collection of payment by us. Your order may be cancelled if it has not passed our verification process or if payment is not received in part or in full by us. In circumstances where your payment is recalled by the associated bank or payment provider, we reserve the right to cancel and refund any order for which an order confirmation has been sent. We accept no responsibility or liability for such cancellations, as these are outside of our control.

For successful transactions, a booking confirmation will be delivered via email to the Purchaser. It is also accessible through your Ticket purchase account. This booking confirmation is not a Ticket and does not permit entry. Subject to instructions from Event Partners, your official electronic ticket (“E-Ticket”) will be sent to your registered email address submitted during the purchase process, at any time from the date of purchase to a date prior to the event date itself.

If you do not receive a booking confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm via your EventAT9 account or contact us here to clarify whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for any costs or losses you incur if you assume that your order was or was not placed because you failed to receive an order confirmation.

Please ensure that you read the full Tickets description details and are happy with your selection prior to purchase as we may be unable to rectify issues arising as a result of your mistake.

ADMISSION, EVENT ITINERARY AND TIMINGS

Please note that advertised start times of events are subject to change. Also, door opening and closing times stated in relation to an event are not indicative of the event’s start or end time (or when an artist is scheduled to play or the length of the artist’s performance), all of which remain at the relevant Event Partners’ and/or artist’s discretion and may be subject to change.

Tickets are sold subject to the Event Partners’ right to alter or vary the programme of an event due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange tickets.

The event venue may conduct security searches of you and other patrons for safety and security purposes and/or may refuse admission to patrons (including you) breaching or suspected of breaching any Ticketing Terms and Conditions of the event or any Event Partners.

Admission to all events is subject to, and regulated by the terms and condition of the Event Partners’ and/or event venue guidelines and certain items (e.g. laser pens, mobile phones, dogs (except guide dogs) and patrons’ own food and drink) may be prohibited. Please check with the venue directly on the list of prohibited items prior to your arrival at the event venue. The unauthorised use of photographic and/or recording equipment at events is also prohibited. Any unauthorised photos, videos and/or recordings may be destroyed or deleted. The use of drones or similar equipment for any reason in, at or near the event venue is strictly prohibited.

Breach of any of venue terms and conditions or any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle the Event Partners to eject you from the venue.

Event Partners reserve the right to refuse admission to the venue, or to remove any person from the venue for reasons of public safety (including crowd surfing or moshing, possession of weapons, controlled, dangerous and illegal substances), any unacceptable behaviour likely to cause damage, nuisance or injury, or for any breach of the Event Partners´ Ticketing Terms and Conditions.

Unless expressly authorised by the relevant Event Partners, there will be no pass-outs or re-admissions of any kind.

By attending an event, you and other patrons understand and agree to being photographed, filmed and/or recorded in relation to the event and/or for safety and security, including filming by the police or other authorised authorities. You and other patrons understand and agree that resulting photographs, videos, audio recordings and/or audiovisual recordings may be used in any and all media for any purpose at any time throughout the world (however, you may object to such use by specific request to info@tykyt.my)

Prolonged exposure to loud music or noise may damage your hearing and we advise you and all patrons to wear adequate ear protection at events.

Special effects, which may include sound, audio-visual, pyrotechnic effects or lighting effects may be featured at an event, which may not be suitable for those with photosensitive epilepsy, or similar conditions

REFUND, EXCHANGES & REPLACEMENTS

Once Ticket is confirmed, no cancellation, refund or exchange is allowed.
Event Partner will only offer a refund or exchange of tickets if an event is cancelled, rescheduled or significantly relocated by the Event Partner (and you cannot or do not wish to attend relocated event). You must apply for a refund within the stipulated refund period announced by the Event Partner or us.

You will not be entitled to a refund or exchange as a result of a change in your personal circumstances. Ticket refund amount excludes Ticket fee, Processing fee or any other Service charges applicable.

Event Partners reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements (including ticket categories), and audience capacity without compensation to the ticket holder.

If an event is cancelled, rescheduled or materially altered, we will use reasonable endeavours to notify you once we have received the relevant information and authorisation from our Event Partners (if you book online, we will use your account details). However, we cannot guarantee that you will be informed of such cancellation, rescheduling or alteration before the date of the event. It is your responsibility to ascertain whether an event has been cancelled, rescheduled or altered and the date and time of any rescheduled event.

CANCELLATION

If an event for which you have purchased Tickets is cancelled in full (and not rescheduled), your order will be cancelled, and you will be refunded the published Sale Price of your Tickets (Ticket Fee and Booking Charges and Processing Fees, if any, may be non-refundable). If you have purchased Tickets for an event that takes place over several days and one or more days (but not all days) are cancelled, you may only be offered a proportionate partial refund.

RESCHEDULING

If an event for which you have purchased Tickets is rescheduled, Tickets will usually be valid for the new date (or you will be offered Tickets of a value corresponding with your original Tickets for the rescheduled event, subject to availability). Subject to the Event Partners’ sole discretion, you will be able to cancel your order and obtain a refund of the Published Price of your Tickets if you notify us within the specified deadline that you are unable to attend the rescheduled event (Ticket Fee and Booking Charges and Processing Fees, if any, are non-refundable). Failure to notify us within any specified deadline that you are unable to attend the rescheduled event will be deemed to be a reconfirmation of your order for Tickets for the rescheduled event, and you will not be able to claim a refund.

To claim a refund under clause 5, please follow the instructions we provide to you. Where we instruct you to do so, you must enclose or return to us your unused Tickets and comply with any other instructions from us.

Refunds will be made using the same means of payment as you used for the initial purchase and proof of purchase will be required prior to refunds being made.

Any claim of a refund arising from our instructions under clause 6 must be made during the normal operating hours as notified to you by us, and within the time frames specified by the Event Partners (in such media as the Event Partners shall determine). Where you requests for a refund after such time period has lapsed, and the amount to be refunded:

a. remains in our possession at the time of request, we shall be entitled to charge you an Administrative Fee of up to 20% of the Ticket Price for the purpose of carrying out such refunds; or

b. has already been returned by us to the Event Partners at the time of request, we shall be entitled to require you to seek the refund from the Event Partners directly. For the avoidance of doubt, we shall not be bound to comply with or fulfil or satisfy any representations or undertakings of the Event Partners which conflicts with clause 8.

C. Without prejudice to any provision herein, save as expressly provided in clause 10.2, 10.3 and 10.4, all Tickets sold shall not be returnable or refundable, and we shall not be responsible to provide or procure any returns or refunds.

d. We will not be liable for any other losses incurred by Purchaser as a result of the cancellation, rescheduling or relocation of an event, including but not limited to travel and accommodation expenses.

e. In order to claim your refund, for some events, Purchaser may be required to fill up a refund request form, which will be made available on this site. Refunds will only be processed upon receipt of a fully completed refund request form.

f. Refunds will be automatically processed to the credit card or payment method originally used for purchase if the transaction made is within 6 months of purchase. For any refunds made after 6 months of the date of purchase, we will reach out to the Purchaser for alternate methods of Ticket Refunds.

g. When you receive or collect your Tickets, please keep them in a safe place. We will not be responsible for any Tickets that are lost, stolen, damaged or destroyed following receipt or collection by you. Please note that direct sunlight or heat can sometimes damage physical Tickets. Furthermore, we strongly recommend that you do not post pictures or details of your Tickets online as this may allow third parties to counterfeit your Tickets or otherwise compromise the integrity of the Tickets and we will not be liable if you are refused entry to the event as a result.

h. You acknowledge that lost, stolen, damaged or destroyed Tickets may not be able to be replaced where policies set by Event Partners prohibit us from issuing replacement Tickets (e.g., for general admission events where there is a possibility that both original and any replacement tickets may be used to gain entry, which may compromise the licensed capacity of the venue).

i. Where your Tickets are for allocated seats, you have a right only to seats of a value corresponding to that stated on the Ticket. We or the relevant Event Partners or venue reserve the right (whether before or during the event) to provide alternative seats to those initially allocated to you or specified on the Tickets.

AT THE VENUE

Please ensure you arrive on time. Whilst every effort will be made to admit latecomers at a suitable break in the event, admission cannot always be guaranteed after the event has started to avoid interruption to the performance and other Ticket holders.

No refund/compensation will be given to a latecomer who is allowed entry into the performance hall/event venue at any time after the event/performance has started.

Please keep your Ticket safe as you will be required to produce it to gain entry to the event. You will also be required to produce your Ticket upon request for inspection at any time. Failure to do so may result in you being ejected from the venue. Your ticket is your responsibility.

You agree that the event for which you purchased tickets is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You irrevocably grant permission to the Event Organiser/Promoter and to each of our designees, licensees, successors and assigns, including without limitation event and program sponsors, advertisers, and marketing partners, to and to own, license, assign and/or otherwise utilise your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmissions, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during, after or unrelated to a performance) for any purpose, in any manner, in any medium or context now known or hereafter devised without further authorisation from, or compensation to, you or anyone acting on your behalf.

You shall not bring into the venue or display or distribute (whether for free or not) at the event any sponsorship, promotional or marketing materials.

You may only leave and re-enter the venue during an event at the discretion of the event crew/staff. Otherwise, there will be no re-entry/re-admission or pass-outs of any kind.

If you are involved with abusive, threatening, drunken or other anti-social behaviour at the event, or are carrying offensive weapons or illegal or prohibited substances you may be refused admission to or ejected from the venue without compensation or refund.

Admission to the venue and the event is subject to the terms, conditions and regulations of the venue and the event management. Amongst other things, you will need to comply with health and safety rules and any security requirements. Any breach of the above may result in you being denied entry to the venue and you will not be entitled to a refund. Tickets may be sold subject to certain restrictions on entry or use, such as restricted, obstructed or side view. It is your responsibility to ensure that you read all notifications and other important information displayed or notified to you as part of the purchase process.

If you encounter any issues regarding the validity of your Ticket or seating related issues at the event venue, kindly proceed to the Ticket Counter/Ticket Box Office to lodge a formal report. Any Ticket validity or seating related disputes must be brought to the attention of the event ground staff, failing which, to the Ticket Counter/Box Office no later than 30 minutes from the start of the performance or event. If no formal report has been made regarding your Ticket or any other Ticket related disputes, no request for refund or compensation will be entertained after the event.
